Judge Nap: Obama's First Political Scandal May Also Be His Last

President Obama leaves office in just over a month, and he may be leaving behind one last scandal.

Judicial Watch is filing a lawsuit against the Department of Justice seeking access to FBI interviews related to the bureau's criminal investigation of former Illinois Gov. Rod Blagojevich.

In 2011, Blagojevich was convicted on corruption charges for trying to sell Obama's former seat in the Senate to the highest bidder.

The conservative watchdog wants FBI reports of interviews, known as “302s,” of Obama, Valerie Jarrett and Rahm Emanuel.

On "Fox & Friends" this morning, Judge Andrew Napolitano explained that Judicial Watch wants to know how Obama and his top advisors responded to Blagojevich's illegal actions.

"It's kind of interesting that what was Barack Obama's first political scandal may turn out to also be his last political scandal, depending upon where this goes," Napolitano said.

He noted, however, that he doesn't expect the lawsuit to go anywhere.

"The policy is, unused evidence in a criminal case - because they were never called as witnesses against him - is secret to protect the witness," Napolitano explained.

He added that while it's unlikely that the 302s will be released to the public, it is "fascinating" that this scandal is coming back to Obama again in the last month of his presidency.
